Funded by the United States Bureau of International Narcotics and Law Enforcement, Department of State, and under the Reducing the Impact of Insecurity on Afghanistan’s Legal System project, the Foundation will conduct a Survey of the Justice Sector of Afghanistan (SJSA) to assess the preparedness of justice sector personnel and infrastructure to withstand security and safety threats while providing better information and contextual analysis about justice sector security in Afghanistan.
The survey will provide detailed understanding about the state of the justice sector, service needs, opposition vis-a-vis other justice service providers, the state of facilities, and its geographic reach. SJSA will be conducted in three stages: 1) stakeholder mobilization and desk review; 2) field assessment; and 3) analysis, validation, and publication. SJSA will be managed and implemented by the Foundation’s Governance and Law department, supported by three international consultants (rule of law specialist, survey specialist, and security specialist) and 33 local consultants based in each of the provinces outside of Kabul.
The main objective of this assignment is to produce a set of recommendations to enhance the ability of justice institutions in provision of justice-related services to the Afghan population. As their development efforts have been hindered by the ongoing conflict and resulting insecurity, particularly the case for judicial sector institutions in vulnerable provinces where anti-government forces’ control of parts of the provinces has resulted in severe damage to provincial justice institutions and subsequent hardships for indigent persons seeking services from those institutions. Recommendations will be informed by data collected under this research component with additional findings from direct monitoring research of several assessments that have been completed thus far, workshops and focus group discussions will be conducted.
Services will be performed over a 4-month period remotely and during several missions to Afghanistan. Travel costs, and mission per diem will be provided by the Foundation. Payment will be made upon satisfactory submission of deliverables as identified in the consultancy terms of reference.
The international expert/researcher will report directly to project manager for SJSA and the director of Governance and Law Programs, and work in close coordination with the surveying partner organizations to perform the following duties and produce a series of staged deliverables:
- Coordinate with project management team to determine research objectives, and create a plan of action, set project goals, and conduct detailed research of intended subject matters.
- Develop a research methodology including all necessary research tools in line with international standards adjusted to the Afghanistan context and work with team to finalize the methodology and research plan including, piloting, data entry, quality control, and analysis.
- Provide technical support to SJSA project team to enable them to supervise and oversee the collection of data using the identified research tools and methodology.
- Ensure that international standards for conducting interviews with various groups of people and samples are upheld.
- Identify gaps and challenges in applying different research approaches, incorporating findings of the research and those of the workshops, conferences and workshops.
- Prepare a draft report with preliminary findings, conclusions and recommendations and validate with the SJSA team and related stakeholders. Feedback received is expected to feed into the development of the final report.
- Prepare a final report on the content indicated by the donors and partner organizations proposed format that will include graphs, charts, mock-ups, and diagrams.
- Formulate effective and efficient research processes.
- Test research methodologies to confirm intended purpose of evaluation.
- Perform fieldwork, interviews, experiments, concept tests, etc. to gather data if required.
- Utilize various professional sources to find and extract pertinent information.
- Frequently self-audit work and check data for errors and inconsistencies.
- Any other required tasks that would relate to the assignments relevant to the project needs.
Throughout this assignment, it will be necessary to:
- Emphasize peer exchange and review, responding collaboratively to feedback and input, under the guidance of the country representative and work in close coordination with the project manager for SJSA and the director of Governance and Law Programs.
- Adhere to and incorporate relevant international and national standards for conducting research ethically and to high standards of quality, including data storage and removal.
- Make available all data collection undertaken to the Foundation’s Governance and Law Department, in line with relevant methodological and privacy considerations as requested.
- Undertake duty travel to Afghanistan (subject to security and other factors) for which round trip airfare, visa fees, accommodation, food, transportation, and insurance will be provided according to standard donor and the Foundation’s specifications.
- Deliver written work that is of publishable quality and adopts a consistent footnote/endnote citation and reference style (to be agreed regionally as needed [e.g. MLA, AP]).
- Perform related duties as requested in the context of adaptive/flexible project implementation.
- At least five years of progressive work experience in the field research; advanced university degree in Research, Economics, Social Sciences and/or related field required.
- Strong research background and experience.
- Technical knowledge and expertise in designing a research methodology, including development of research tools, data collection, quality control, data processing and data analysis, as well as training and working with national teams.
- Excellent analytical and organizational skills.
- Experience conducting research in developing countries preferred.
- Experience using statistical analysis software.
- Strong math and statistical skills.
- Well-versed in database management.
- Ability to conduct research of publishable quality.
- Ability to travel within the country where security permits.
- Effective communicator, both orally and written.
